ACCIDENTS at work we often hear about. The question is often raised, what is the cause, especially in sectors involving the use of machines and machinery? More unfortunate, in addition to negligence, there are accidents due to corruption. For example, in 2017, we were shocked by the heartbreaking story of a 17 -year -old teenager who died as a result of being stuck in the gap between the elevator and the ceiling at his workplace. So, how can a machine operate without CF?

The Malaysian Anti -Corruption Commission (MACC) through the Inspection and Consultancy Division (BPMP) has proposed several improvements so that the space and opportunities for corruption and abuse of power can be closed in the process of registration and inspection of machinery and factories by the Department of Occupational Safety and Health (DOSH). The results of the MACC inspection found that the factory and machinery registration matters between the PK-01 Document Quality Management System Working Procedure and the Malaysian Occupational Safety and Health System (MyKKP) for the issuance of Rejection Letters were inconsistent. The Rejection Letter is a document issued by the DOSH inspector after finding that there is non -compliance in the application for Permission to Install Machinery after conducting an initial visit. However, the process of issuing the letter does not need to go through the Head of Section or the Deputy Director. This can cause JPPK inspectors who do not have integrity to take the opportunity to nod in murky waters.

In this regard, the MACC is of the opinion that the coordination of MyKKP should be made by mandating that decisions or letters distributed to applicants should go through the Head of Section or Deputy Director to create an element of transparency and check and balance. JPPK made adjustments to the system as well as creating a no -cost monitoring element on the production process of the Rejection Letter in the existing MyKKP system. Through the improvements, the Section Head and Deputy Director will be notified via e-mail of each issuance of a 'Letter of Rejection' by his supervisory officer. DOSH also informed that through the improvement, direct monitoring of JPPK officers is easier and the detection of an issue can be made quickly.

Meanwhile, weaknesses in the management of the cancellation of Repair Notices and Prohibition Notices under Sections 48, 49 and 50 of the Occupational Safety and Health Act 1994 (AKKP) were also identified. The results of the MACC's review also found that the cancellation of the notice issued by the officer was not referred to the supervisor, namely the Head of Section or Deputy Director first. Instead it is done by the same officer who issued the notice where reference to the Head of Section will only be made if necessary. This clearly shows that the examining officer has very great power in approving the relevant application.

To avoid the accumulation of power by officers, improvements are made where every cancellation of Repair Notice and Prohibition Notice under Sections 48, 49 and 50 AKKP must be reported to the supervisor to create a check and balance element, thus increasing transparency in the process of issuance and cancellation of notices.

In this regard, DOSH made improvements on the quality procedure document, namely PK-05: Management of Notices, Compounds, Prosecution and Appeal by creating a check and balance element in the process of revocation of notices by JPPK officers. Through the same system, supervisors will receive notification via email for each cancellation notice issued by the DOSH inspector. Through this improvement, DOSH supervisors can monitor each cancellation of DOSH Repair Notice 3 (NOI) and DOSH Prohibition Notice 2 (NOP) more easily. This is because the monitoring element is very important to ensure that every DOSH inspector always practices high integrity in performing their duties.

Apart from monitoring through e-mail notifications, the state DOSH also acted proactively to introduce a special stamp on the notice as proof that the check and balance process has been carried out, apart from signing the notice. To ensure overall effectiveness, the innovation is now being extended to all branches and states. Apart from that, the issue of constraints on the number of DOSH inspectors as well as the workload caused the inspection process to be carried out alone based on the application for registration of factories and machinery. The proof is that in 2017, DOSH only had 893 technical officers, namely Factory and Machinery Inspectors nationwide compared to 78,800 total applications.

The preventive measures and improvements taken by DOSH to some extent bear fruit in the following years. Based on data from the MACC Records Management and Information Division, there was a significant decrease in 2019 in relation to the receipt of corrupt information involving DOSH officers. For 2015 and 2016, a total of two corruption information was received related to DOSH. The number increased dramatically in 2017 with 13 corrupt information received. For 2018 and 2019, the number began to show a decline with nine and three corruption information received respectively. For 2020, only one corruption information related to DOSH was received

This clearly proves the existence of check and balance elements as well as high integrity practices in inspections can prevent corrupt activities and abuse of power. At the same time, the matter also reflects that integrity inspections are important in ensuring that the organization complies with the laws set by the government, in addition to ensuring the safety and health of employees who serve under the organization.
